Protection of Private Information (POPI) Act 4 of 2013

Private BuilderTM is committed to adhering to the guidelines set out in the act, as updated 01 July 2021, and so is committed to protecting all information provided to us via the portal, within all means inside of our control. 

The portal is intended to be a community based platform that connects all users especially “owners” with “contractors” etc. It also serves as a platform for advertisers to reach potential buyers of their products and services.

By registering as a user on the Private BuilderTM Portal, you acknowledge and hereby consent that your personal information will be displayed in the public domain and accessible to other users of the portal. “Users” of the portal are defined in our terms and conditions and can be accessed on the portal.

By registering as a user, you also  acknowledge and hereby consent that your personal details like name, surname, e-mail address, phone number and location can be published via the portal into the public domain.

By recommending contractors you confirm that you have received consent from that contractor to have their details published via the portal for others users to access without restriction.   Users and contractors, hereby accept that it is impractical for Private BuilderTM to be able to validate that this consent is in place.  Users also accept that should they decide to withdraw their information from being published, then this will need to be done in writing through the portal’s “contact us” feature or via our email channel.  Users, advertisers and contractors accept and hereby consent that sharing publicly of their contact information is an integral part of how the portal works.   Users who access information on the portal and users who recommend contractors understand also that  opinions on the platform are of a personal nature based on their experience and by no means is meant to be of a malicious nature and consent that those opinions and ratings be shared openly to other users and  there will be no control mechanism that can be implemented to limit this information to that specific user or just the users of the portal. In other words, users can easily share any contact information and opinions obtained on the platform, with anyone else and this despite them being cautioned not to do so, (and because of that reason), it is practically impossible to tightly control that the information does inadvertently get out into the public domain through no action of Private BuilderTM .

By being a user of the Private BuilderTM platform, you also accept that Private BuilderTM communicates with its users from time to time through email, letters, facsimiles and direct telephone calls. The purpose of this communication serves many purposes, from keeping you up to date on latest developments on the portal, as well as discounted offers and solutions available to you through our advertising network. You hereby grant consent to receiving such communication and acknowledge that at you can choose to opt out of this  communication by contacting us through the portal.

It is important to note that data acquired from Private BuilderTM is considered to be the intellectual property of Private BuilderTM and is for the sole use of Private BuilderTM services and may not be on on-sold to third parties. Should it be discovered that a user is on-selling Private BuilderTM data to third parties, it will result in the immediate suspension of the user and could lead to possible litigation of that user by Private BuilderTM.

The use of cookies on our portal
A cookie is a small file that asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about webpage traffic and improve our website by tailoring it to our customers’ needs. We only use this information for statistical analyses, thereafter the data is removed from our system.

Governing law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit any dispute arising out of your use of this portal to the exclusive jurisdiction of the courts of the Republic of South Africa.
